These Terms of Service govern your use of PonyUp and its digital bill of sale services. By using PonyUp, you agree to these terms.

1. Service Description

PonyUp provides a digital tool that helps private parties create, sign, and store a bill of sale for vehicles, equipment, trailers, boats, and other approved asset categories.

2. No Legal Advice

PonyUp is not a law firm and does not provide legal advice. Our service is a document preparation and transaction-record tool only. You are responsible for determining whether the document is appropriate for your transaction and local laws.

3. User Responsibility

You agree that the information you provide is accurate and complete. You are responsible for:

  • Verifying the identity of the other party
  • Confirming ownership and authority to sell or transfer the asset
  • Reviewing all information before signing
  • Complying with all state and local title, registration, tax, and disclosure laws

4. Payments

PonyUp charges a one-time fee for bill of sale creation unless otherwise stated. Fees are shown before checkout. By paying, you authorize PonyUp and its payment processor to charge the amount shown.

5. Refunds

Refund requests are governed by our Refund Policy. In general, completed document transactions may not be refundable once the document has been generated or delivered.

6. Electronic Signatures

By signing through PonyUp, you agree to use electronic signatures and records for the transaction. You acknowledge that electronic signatures may have the same effect as a handwritten signature, subject to applicable law.

7. Acceptable Use

You may not use PonyUp for unlawful, fraudulent, misleading, or abusive purposes, including:

  • Submitting false ownership or identity information
  • Using PonyUp for stolen or illegally possessed property
  • Attempting to interfere with the platform or its security
  • Using the service in violation of any applicable law

8. Limitation of Liability

To the fullest extent permitted by law, PonyUp shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for disputes between buyer and seller arising from any transaction documented through the platform.

9. Disclaimer of Warranties

PonyUp is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

10. Changes to These Terms

We may update these Terms of Service from time to time. Updated terms become effective when posted on this page.
